Terms and Conditions for buyers

The following are the terms and conditions for the use of the website 3to3 for Buyers to abide by. This Site is managed by Wales Council for Voluntary Action.

Please read the following policies carefully before using the Site. By using the Site, you signify your agreement to be bound by these conditions and by the Privacy Policy.

In these policies, the following definitions apply:

"3to3" or "3to3.org.uk" (also referred to as ‘we' and ‘us') means the website "3to3.org.uk" which is run by Wales Council for Voluntary Action;

"Site" means 3to3's online shopping website at www.3to3.org.uk;

"WCVA" is the Wales Council for Voluntary Action, which manages the 3to3 site;

"User" (also referred to as ‘you’) refers to someone who uses the Site;

"Vendor" or "Seller" refers to a member organisation of WCVA who has registered to use the site for retail purposes, create and maintain product or service listings and charge a fee for their products when selling them to customers of the 3to3 site;

"Customer" or "Buyer" refers to an individual or organisation that makes a purchase on the Site;

"Listing" refers to a product or service listing created by a vendor in order to place their item onto the Site for selling purposes.

"Privacy Policy" means 3to3.org.uk’s Privacy Policy.

1. Amendment to these terms and governing law

1.1 WCVA may change these terms of use occasionally and will endeavour to notify you of any major changes by posting a message on the Site. By browsing the Site you are accepting that you are bound by the current terms of use. Please review this policy each time you use the Site as it is subject to change at any time by WCVA without notice to you;

1.2 This Agreement constitutes the entire agreement between WCVA and you and supersedes all prior agreements, representations, statements and understandings between WCVA and you regarding the use of the Site. You agree that you have not relied upon any representation or statement not recorded in these Conditions in entering into this Agreement;

1.3 The failure of 3to3.org.uk to exercise or enforce any right or provision of this Agreement or the delay by 3to3.org.uk in so doing shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The section titles in this Agreement are for convenience only and have no legal or contractual effect.

2. 3to3’s role

2.1 3to3 is a host venue for various sellers and helps to showcase their products, services and initiatives to customers;

2.2 3to3 is not directly involved with any transaction between buyer and seller;

2.3 3to3 has no control over the content of products, services or initiatives and does not make any guarantees over its quality, legality, moral ethics or safety;

2.4 Individual sellers are responsible for creating and uploading listings; 3to3 has no control over the content of any listing and makes no guarantees over the accuracy of its information;

2.5 3to3 cannot guarantee that a buyer or seller will complete a transaction after having declared its intent to purchase/sell a product or service;

2.6 By using the Site, you agree that 3to3, as a venue, is not responsible or liable for any content made available by a third party, and has no liability for any transaction carried out on the Site. You use the 3to3 service at your own risk, with no liability or responsibility on the part of 3to3 or WCVA.

3. Permitted Actions

You may:

3.1 purchase goods from the Site, provided you accept the ‘Terms of Sale: Buying’ section of these terms and conditions, which will apply to any contract made between you and 3to3.org.uk for the purchase and sale of goods from the Shop. These terms are outlined in Section 2;

3.2 browse the Site using a compatible web browser. Permission to browse the Shop includes permission to make transient or cached copies of parts of the Shop to the extent that this occurs in the normal course of using your browser and that these copies are used only to facilitate current or subsequent access to the Shop by you; and

3.3 print a copy of any page of the Shop for your own personal purposes only.

4. Non-permitted Actions

You may NOT:

4.1 remove or change anything on the Site;

4.2 copy or use any material from the Site for any commercial purpose;

4.3 remove or change any copyright, trade mark or other intellectual property rights notices contained in the original material or from any material copied or printed off from the Site;

4.5 modify, adapt or hack the 3to3 site;

4.6 modify another website so as to falsely imply that it is associated with 3to3; and

4.7 access or use the Site using automated means, e.g. spiders.

4.8 Enter into transaction through the Site if you are under 18 years of age.

5. Your personal information

Usage of your personal information is governed by 3to3.org.uk's Privacy Policy.

6. Third party web sites and links

This Site contains links to other third party web sites, which are not under the control of and are not maintained by 3to3.org.uk. Any such links do not constitute an endorsement by 3to3.org.uk of any products or services available on such sites. 3to3.org.uk provides these links for your convenience only and you use such links entirely at your own risk. We accept no responsibility for the content or use of such sites or information contained in them.

7. Site Maintenance

3to3 may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Shop from time to time. Access to or use of the Site or pages linked to it will not necessarily be uninterrupted or error free.

8. Multiple Vendors and Supply of Products

Any potential customer on the 3to3 website must be aware that

8.1 3to3 uses a multi-vendor system in which associated organisations are able to create product listings of items for sale on the website. 3to3 does not supply, deliver or receive payment for any of the items on the Site nor does 3to3 create the listing for the product or service;

8.2 the quality of the items/services or the content contained within an item or service listing are not the responsibility of 3to3 but are the responsibility of the named vendor which appears with a product listing;

8.3 in the event of the Customer adding multiple amounts of different items to their shopping cart, the Customer may have to carry out more than one transaction in order to pay each vendor individually for their products, rather than just one transaction for all items in their shopping cart;

8.4 3to3 or WCVA are not responsible for the delivery method, times or costs of any item on the Site unless stated;

8.5 3to3 or WCVA are not responsible for the quality or content of any product or service listed on the Site unless stated;

8.6 3to3 and product vendors reserve the right to discontinue items or services on the website in the event of stock shortages, maintenance or for any other reason. 3to3 may do this at any time and without notice; and

8.7 3to3 or WCVA are not involved in any transaction on the site whatsoever.

9. Contract of Sale

By placing an order on the site, you

9.1 are stating that you are over 18 years of age and are making an offer from the seller named on the listing to buy the chosen product/service at the price and in the currency stated on the listing;

9.2 will receive an email confirming your order from the named vendor, which acts as acceptance of your offer to buy the product/service;

9.3 accept that 3to3 or WCVA are not responsible for accepting returns of faulty goods. As each vendor will have a different returns policy, you are advised to contact the vendor before purchasing to enquire about their returns policy;

9.4 may obtain a seller’s email address, postal address and other contact information as part of the buying process on 3to3. You may only use this information for 3to3 related communications and for the purposes of facilitating a 3to3 related transaction and not for advertising or any other types of communication without consent from the seller.

10. Payment Method and Transaction Disputes

10.1 WCVA uses PayPal as its payment method for transactions on the 3to3 website, with all vendors agreeing to use it to process payments;

10.2 PayPal must be used to carry out transactions over the Site. This will involve registering with PayPal to activate an account, should you not have one already;

10.3 Any transaction disputes between customers and vendors are not the responsibility of 3to3 or WCVA. These can be resolved by using the PayPal Dispute Resolution process;

10.4 Neither 3to3 or WCVA accept no responsibility for any problems or technical errors you may incur while using PayPal.
